Art’s Sprinklers of Albuquerque, New Mexico posted a performance bond before working on the Moly Corp baseball field for the Village of Questa New Mexico. Who is the bond holder?

You should be able to contact the obligee (owner) of the project to get a copy of the bond. This should be public information. In this case it may be the City of Questa.

I’m assuming that you are trying to put a claim against their bond for payment. You need to be sure that a payment bond was issued with the performance bond. A payment bond is not automatically issued with a performance bond. The obligee needs to request it.

FYI, claims against the payment bond are far more numerous than against the performance bond. Especially with smaller contractor who can only pay their suppliers when they get paid by the owner.

Have you approached the contractor and advised them that you are considering a claim? That should be your first step. Having a claim against one of your bonds is not the end of the world but it does make things a little complicated for the contractor when they go for their next bond. You should try to work it out with them first.

I advise all of my contractors that when they are working under another contractor and it is public work, get a copy of the bond before you sign the contract. it should be at the top of your punch list.
