Q&A: Do I have a right to appeal my YouTube ban?

Months ago, I uploaded a music video which featured a different, licensed song played over the top. I was banned from YouTube for uploading this video, even though I included a clear, referenced disclaimer posted in the video’s description. (It’s probably important to note that before my ban, I did receive a valid copyright warning from YouTube for uploading a clip of South Park.)

A written disclaimer seems to be a legal waiver in Fanfiction, in many other videos on YouTube (which clearly use copyrighted material) and I even sought the advice of a lawyer friend who said that as long as I included a disclaimer I should be able to upload the video with permission.

Apparently if I appeal my ban and don’t have any legal footing in this case, I could be sued by the company accusing me of copyright infringement.

Has anybody else faced this problem? Do I have a legal right to appeal my ban?

I would print a copy of Terms of Service, get copy of warning, and anything else you have in this case. Then speak with an attorney who specializes in copyright laws.
