Okay so, last year almost a complete year ago I got pulled over in a truck I had JUST BOUGHT off some guy I work with, and I had probably a half pound of weed under the seat. No license, no registration, no title, my room mate and I were both drunk, had open containers spilled in the truck, etc etc. The police also caught my room mate eating a gram of weed and he tried lying about it.

They booked us both, towed my truck. Took us to the station, put us in different holding cells. They sat me down with a tape recorder and asked me a bunch of questions. It was so long ago I can’t remember EXACTLY what I said but it was somewhere along the lines of “I bought it for 40 bucks off some random mexican in the projects that I met, as I was sitting at a park waiting for a friend”.

They charged my room mate with “lying to law enforcement” and me? NOTHING. They let us both go after that. No ticket, no citation, no court date, they didn’t SAY anything about that stuff let alone GIVE me anything. Since then I’ve quit dabbling with pot, and I’ve also been pulled over/had my ID ran, been arrested, had to go to court since then, and NO ONE ever said ANYTHING about the incident.

Then I enlisted in the Army about 2 months ago. Went to the Medical Enlisting Processing center (MEPS), had a physical/bunch of police scans done, drug tests, all went smoothly and came back clear. So I signed the contract in the Army on March 19th for Infantry.

My ship-out date was suppose to be April 27th. On April 24th my recruiter calls me at like 8am, waking me up out of bed and asks, “Are you SURE you’ve never been arrested/caught with weed?!” I said NO thinking the incident was never on record/file (I never got anything in the mail, either). He goes “Well it looks like theres another guy in the same city as you who got caught last year with weed, but the birth dates are different, so we need to go to court to get this cleared’. SH#*!

So we went down to the Superior court to get the facts. I was thinking the case DID get put on record but seeing as how I never had court/fines/etc it got dismissed. So my recruiter picks me up and we go down, and ask about my record, and the guy tells me I’ve got an OUTSTANDING WARRANT FOR MY ARREST. BECAUSE I MISSED MY COURT DATE. Whaaaaat?1 Theres gotta be a mistake. They would have let me know when I got pulled over numeriously/went to court/etc. So we go to ANOTHER Superior Court/Justice center place, to meet with someone to see how we can get it cleared. My recruiter met with the lady while I waited in the lobby. Then they call me back, fingerprint me, say “it matches” and a cop comes around the corner, BLAM slams the cuffs on me. Just like that. Right in front of my recruiter who’s like ?!?!

Spent the day in jail, went to a little pre-court thing and the judge told me my charge is “Marijuana possession/use – Class 6 Felony” and that I’ve got court next month on the 11th. I said I couldn’t afford my own lawyer and she said she’d appoint me an attorney.

There goes my shipout date, which was suppose to be monday to Fort benning Georgia for basic training.

I’ve been told numeriously this can/should be dropped to a misdemeanor, assuming I get TASC (drug tests ever week for cpl months) or probation, community service, something along those lines. If it STAYS as a felony while I’m PRAYING it won’t, Army won’t want nothin to do with me. My granny might hire a lawyer. I dont know what to expect at this court. Will I be allowed to speak my side? I wonder if because I enlisted/tried enlisting (I had to sign a paper to un-enlist myself after they found out) that it’ll look really good to the judge and he/she will be light on me. Or if it’ll look WORSE and he/she’ll be like “O SO U TRIED RUNNING HUH?! YOU LIAR !” I dont know.

I just know I need the Army BAD, and I’m really stressing. Any help/info/advice would be great.
