management and noisy neighbor?

Question by ツ: management and noisy neighbor?
I need help with my upstairs neighbor they are so annoying
i can hear the kids jump up and down at all time of the day and about 2 or 3 times a month they have these all night parties from like 10pm to like 7am I have called the police on many occasions but they just turn down the music for a little while and then begin again.

Finally on friday i got fed up and told the owner/manager I called him like 10pm and told him about the noise but that well did nothing they still partied till 4am

So today monday I’m calling the owner again and well thought of 3 options
1 He moves me to another unit
2 He makes a contract with the woman stating they will have no parties after 12/1 am
3 He refunds my deposit and i get the hell out of there

On my lease it states that no neighbor unreasonably should disturb the peace

What do you think do you think the owner would go for any 3 options?

You’re right in calling the police. Even though the cops just ask them to turn the music down, if the police get enough complaints they will start imposing fines. Most cities have laws against noise which go into affect after 10pm.

Also, you should talk to your other neighbors. If you are the only person complaining, the apartment management is likely to do nothing. But if you can get others on your side they will be forced to act. If the noisy neighbor is in violation of her lease, and enough residents complain, the landlord will have to issue a warning that subsequent complaints will result in eviction.

I think that if you wanted to press the issue, you could take your landlord to court and file for breach of contract since he/she has not been able to keep the noisy neighbor in line. But that could end up costing more than you’re willing to spend (both money and time).

Your best bet in this case is to get the support of other neighbors. The landlord cares about keeping his/her units filled. If he there are several tenants threatening to leave because of the actions of 1 tenant… well, even a landlord can do THAT math!
