My husband is currently over seas and is buying land from his grandfather in the form of contract for deed.?

Question by mandy: My husband is currently over seas and is buying land from his grandfather in the form of contract for deed.?
Since he is not present, his family has been using the land as they please. My husband does not want them to be on or use the property, but they tell him there is nothing he can do because he is still paying on the land. Can’t he have the positions removed from his property.
Yes I know his grandfather has say so, but people such as his mother and step father! The two of them are holding the land over his head and using it for their horses, he feels that he should beable to prevent their actions.

It depends how the contract is worded. If it states that title shall pass to your husband upon completion of the payments, they the family is right in what they say. Read the contract for an answer to this. Usually a contract for deed does not transfer title to the buyer, but merely sets down the manner in which payments can be made. these payments are like an advance on a down payment. in this case, even though your husband is making payments, these payments are merely going towards a future down payment, and these has not yet been a transfer of title. The grandfather is still the owner of the property.
