Can a Verbal Agreement Written Contract Hybrid be enforceable?

Question by GuardianVolt: Can a Verbal Agreement Written Contract Hybrid be enforceable?
===== LONG STORY SHORT =====
– I own multiple companies and they all use contracts between clients.
– Mailing contracts, getting them signed, & mailed back takes too long and is expensive.
– Signing in person is also expensive.
– Using digital signing (echosign, docusign, etc…) is also expensive.
– We want to streamline the document signing process.
===== HERE’S THE IDEA AND THE PROBLEM=====
– Have a client sign their contract using their voice over the phone, (verbal agreement), however, there are many limitations to this, $ 500 limit rule and also terms and conditions may vary.
– Written agreements are always enforcable by law, and it’s well known that when you sign a written contract you agree to all terms and conditions, where-as a verbal agreement’s terms and conditions may vary.
===== THE SOLUTION, AND MY QUESTION TO YOU =====
How about this… Lets make a hybrid.
– I write up a contract and give it a unique number (example:#ABC123) – This contract number is NOT in the filename but INSIDE the contract,which is a password protected PDF file.
– I email this password protected PDF to the client along with the password to open it.
– The client opens the contract and at the top of the contract is the contract number #ABC123.
– The client prints out the contract and signs it, in the terms and conditions of the contract, it states that the client must read and agree to all terms and conditions, and then they are to call my offices special phone number (###) ### ####.
– The number leads to a voicemail box that is recorded and saves the entire message.
– The contract asks them to call and leave a message to confirm that they received, signed, and dated their contract. Like below…
– “Yes, i John Doe received contract #ABC123, and I agree to all terms and conditions, I also confirm that on (date) I have physically signed my contract.”
– Done, the client has given testimony to signing a legally binding document, without having to mail it back and forth. And the proof for this is their own voice.

Is this OK? Does this sound good.

You will need a secret handshake as well.
Having your client close his eyes and turn around three times counterclockwise while saying his name backwards will help as well.
This and a secret handshake is all you will need for a binding legal contract.
