I hired an entertainer to perform in April for a dance we both agreed on $ 300.00 and both sign the contract. I serve two years on the committee and turn it over to someone else who decided not to honor the contract for no reason. It is past practice that the chairperson lines up the entertainers for the present year. I have 2011 schedule for the year, can he just not honor the contracts and not pay these people? The Chairperson of the activities did not support the contract. Does the entertainer have a small claims case? Are contracts not binding?

Yes, contracts are binding.

If you tell them it’s canceled before they show up and the performance never takes place, then you probably have nothing to worry about. They can’t charge you for a service that was never rendered, and it’s doubtful they would waste time and effort trying to sue you for canceling a $ 300 gig.

However, if the current chairperson is planning to have them perform and just not pay them for it, then yes, they have a case and, frankly, deserve to win.

Entertainment is just like any other service. If they do the work, you gotta pay. If they do take you to court and win, it will probably end up costing more than $ 300, so it’s in everyone’s best interest to do the right thing and let them know beforehand.
