Model has not yet sent a copy of her ID, can’t use the set till she does?

Question by matthew: Model has not yet sent a copy of her ID, can’t use the set till she does?
Hi. Worked with a model, photographed 5 sets. She signed the model release contract. Didn’t have her ID because she said the Chicago police had taken it at a traffic stop. She’s on a modeling website, and sure she’s 21, at least over 18. She said she would send a copy through email soon after. I edited a couple of images for her portfolio, now she hasn’t sent the ID and it’s been a few months, my patience is at an end. Told her she no longer had permission to use the images for she has not completed the contractual agreement in supplying me with a copy of her ID for the file.

My question is, what can I do? The studio and film cost money, I can’t use the images because I don’t have her ID on record. Or can I? Can I bill her for the cost of supplies and studio time?

Actually see a lawyer to draft a short letter on their letterhead indicating she will be taken to small claims court for reimbursement to you of supplies and studio time if she does not comply. It will be a nominal fee ($ 10 most likely) and that can kick start her. Usually the lawyers have a free 1/2 to 1 hour initial consultation time, so you can ask them if this is the best thing to try.
