I am creating a DVD for distribution, want to use music in the background. If the songs and productions of the songs are over 95 years old, will I be violating copyright? All video is new material, and I don’t want problems with background music.

If the songs are over 95 years old, the songs themselves are in the public domain. However, the recordings of the songs which you intend to use are probably still protected by copyright. Unauthorized use will get you sued, and you will lose.

You can record new versions based entirely on the written music from 1914.
