We have an accepted contract on a house. We added in the contract for a climbing wall that the owner erected in the home. The owner agreed and signed. On returning to the home, we have noticed 20 climbing stones are missing from the climbing wall. We have asked Why? Our agent said they will be replaced, but we think this is unacceptable. Why remove them? What are we able to do? We want to buy this house. We already had it inspected. How can they remove stuff contingent on the sale?

Has settlement occured yet, if not then the vendor has until settlement to rectify the problem. Always conduct a pre settlement inspection of the property as close as possible to settlement. If the vendor has breached a clause in the contract then you should notify your solicitor to delay settlement until this happens, you should also ask about compensation for any out of pocket expenses that you may incure because of this. If it is in the contract, then the seller has no right to remove it. If you have already moved into the property then seek legal advice on what to do.
