For example, if a homeowner hired a contractor who did such a bad job that the house looks worse after the work is done but he refuses to do any remedial work. The homeowner sues in small claims but loses because the judge says the contractor did what was specified in the contract and there is no provision for the quality of the work done. After the settlement, the contractor turns around and sues the homeowner citing that because of the suit, he lost time from work to have to come to court plus he now has a blot on his record and is losing contracting jobs because of it. Can he win or would this be considered a frivolous suit?

Sounds like a pretty good suit that would be easy to win to me…
