A company contacted me through Flickr mail. They want to use one of my photos for an internal presentation to one of their clients. The photo is one of my candid photographs. They will compensate me for an amount as usage fee. And, they want me to sign a photographer release form as soon as possible.
According to Wikipedia,
"In general, one cannot publish someone’s image to endorse a product or service without first acquiring a "model release," which is usually a contract between the publisher or photographer and the subject." (Street Photography)
"Publishing an identifiable photo of a person without a model release signed by that person can result in civil liability for whoever publishes the photograph." (Model Release)
The photo is a candid shot. Can we consider the subjects as models?
The photo will be used only in a presentation for a particular client. Can this be considered as publishing?
