Downstairs students averaging less than 4 hours sleep due to upstairs residents video games and music. Landlord dragging feet, although provision in lease agreement is clearly being violated. Nuisance incidents logged and documented, including police reports.

You can be sued for the remainder of the lease.

As much as I hate to say this, a landlord has very little authority to stop this type of behavior. If he tried to evict the tenants it could, depending on where you are, take months and then there is no gaurentee that the courts would actually evict the tenants.

Your best course of action is to keep calling the police or go buy a copy of Phantom of the Opera and blast the barrel organ music when they are trying to sleep.
