Non Performance on New Construction?

Question by Al: Non Performance on New Construction?
I entered into a contract including a 3% deposit on a new condo construction. I was relocated for work before construction was completed. The contract was non-assignable without a relocation clause.
The deposit was non-refundable. If I forfeit the deposit and walk away, is there any likelihood they could come after me for non-performance on the contract?
