Laws for Music Sampling + Free Distribution?

Hello everyone, I’m in the process of recording an album that has a bit of sampling on it (mainly video game tracks and a few older things).

I was wondering about the laws for sampling – I’ve read that if you make money off of it, it’s pretty much mandatory to get the rights unless that artist allows it (Creative Commons I believe). My question now is:

1. If I release this album for free, could I still use my 6-second samples without any legal work?

2. If I could release my album for free and not pay sampling-rights, will I be able to make money through a donation-ware like setup?

3. I’m sure some of you know Radiohead’s “free” release, which utilized a pay-as-you-want concept. What would be the legal steps in making an album that will *technically* be free, but can receive donations for?

This is completely an independent project by the way – no physical CDs or anything in production!
