When an operator is late for a delivery and a Detention form is sent out is that considered a contract?

Detention charges apply when unloading is delayed betond a reasonable time.
For example, a delivery of 20,000 lbs might allow 5 hours to unload. If the consignee takes longer, then detention charges begin to acrue.Detention i indicated in the original bill of lading, which is the contract of transportation.
