Question by Glynn: In the state of Kentucky, can a recorded contract stand as evidence in court?
I contracted with Bell South to advertise in the yellow pages, when the directory came out, they had one ad under the wrong heading and the other was smeared so bad that it was unreadable. I refused to pay for it. They have been calling and harassing me for about a year now trying to get me to pay it. I don’t feel like I should pay for something I did not get. Do they have a case to sue me? If they do, why haven’t they already? Any suggestions?

How detailed is the contract? Perhaps they haven’t sued you because they know that they didn’t perform on their end to make good on the contract. I’m not a lawyer by any means, but it seems like you got enough proof to stand your ground.
