How Do I take someone to Court that lives out of state?
Question by Frank Lucas: How Do I take someone to Court that lives out of state?
A promoter in New Jersey Hired Me for 2 performances with my band. We saved both dates for him, He agreed in Contract to Pay us, plus reimbursements for hotel and plane tickets. He bailed out on us and left us stranded with plane tickets which would be no good to us anymore. Along with hotel bills, and 2 days of no pay.
We had a contract, the contract states, we would still get paid even if he decided to pull the plug. He is new Jersey, I am in California, the events were supposed to take place in Texas. He owes me approximately 5,000 dollars. Would I have to fly back and fourth to New Jersey? I found out he is a resident, but not a citizen. I also have his phone numbers, and home address. How do I take care of this, he already stated he would no give me a cent. and now he rejects all my calls.

Take this to small claims court which can pay up to $ 5,000 on a claim. I’m sure you can do this in California. Google “small claims court” for your locale, to find out more information, like where to get the forms for filing and how to supoena him. The best part of this is that you can force him to come to California, instead of you going to New Jersey.
Make sure you have all the documents to show the judge, and any emails exchanged between the two of you. You sound like you have all the information you need to make this jerk pay up.
