I have been waiting for 2 months for O2 to replace a band new but faulty handset. They have sent me back a refurb phone in a model I didn’t want. In the process I have had repeated contradictary replies from theircustomer service department. Does this qulaify for me for early termination of the contract? And does anyone have any suggestions on how to word the letter? Thanks in advance

That depends on the terms of the contract. If you kept a copy, dig it out and read it to see what it says. As long as it’s not illegal wherever you live, your contract may say you have to dye yourself blue and go to church naked before they’ll let you break the deal.
If you don’t have a copy of the contract, you’ll have to come up with one somehow.
